These terms set out the rules for using our website, www.lvs.ascot.sch.uk (Site).

The Site is operated by LVS Ascot with its registered office at London Road, Ascot, Berkshire, SL5 8DR [a registered charity under number 230011].

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved, which means that you cannot reproduce, duplicate, copy or re-sell any part of the Site without our prior permission.

Your use of the Site

How you may use the material on the Site

You may print off one copy, and may download extracts, of the text of any page(s) from the Site for your personal use.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged.

You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors, nor may you use the Site, or any extract from it, for any illegal or immoral purpose.

If you print off, copy or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must return or, at our option, destroy any copies of the materials you have made.

You must keep your account details safe

While the Site is free to use, some parts of the Site are only available to certain registered users. This section is only applicable to such users.

If you are a registered user, you will have been provided with a unique username and password. You must treat such information as confidential and must not disclose it to any third party.

We have the right to disable any registered user’s access at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these terms of use.

You must not introduce bugs and viruses, or otherwise misuse the Site

You must not misuse the Site by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful.

You must not attempt to gain unauthorised access to the Site, any user, the server on which the Site is stored or any server, computer or database connected to the Site.

You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.

A breach of this provision, could constitute a criminal offence under the Computer Misuse Act 1990. Accordingly, we will report any such breach to the relevant law enforcement authorities and we will co-operate fully with those authorities which may include disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

Our liability to you

We are not responsible for use in any location other than the UK

We do not represent that the content available on or through the Site is appropriate for use or available in other locations other than in the UK and will not be liable for any losses that you suffer as a result.

Do not rely on information on the Site

The content on the Site is not intended to amount to advice on which you should rely.

Although we make reasonable efforts to update the information on the Site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date, and are not liable to you for the same.

We are not responsible for websites we link to

Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those websites or resources and are not liable to you for their contents.

We are not responsible for viruses

We do not guarantee that the Site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software.

Our responsibility for loss or damage suffered by you

We are not liable for any loss or damage that arises from the use of the Site by you or any other user that is in breach of these terms.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

If you are a business user, we:

  • Exclude all implied conditions, warranties, representations or other terms that may apply to the Site, or any content on it.
  • Will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the:
    • use of, or inability to use, the Site; or
    • use of, or reliance on, any content displayed on the Site.
  • Will not be liable for your:
    • loss of profits, sales, business, or revenue;
    • business interruption;
    • loss of anticipated savings;
    • loss of business opportunity, goodwill or reputation; or
    • any indirect or consequential loss or damage.

If you are a consumer user, please note that:

  • we only provide the Site for domestic and private use;
  • you agree not to use the Site for any commercial or business purposes; and
  • we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If defective digital content that we have supplied, damages a device or digital content belonging to you, and the defective digital content is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that was caused by you failing to correctly follow installation instructions or to have in place such minimum system requirements advised by us.

Nothing in these terms affects any of the limitations and exclusions of liability set out in any other legal document of ours (including, without limitation, the Privacy Policy and Cookie Policy).

Your liability to us

You are responsible for all uses of your account and/or internet connection. You must ensure that your account details are kept confidential and that all persons who access the Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Rules about linking to the Site

You may link to the Site, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to the Site in any website that is not owned by you.

The Site must not be framed on any other website.

We reserve the right to withdraw linking permission without notice.

Applicable law

If you are a consumer, these terms of use, their subject matter and their formation, are governed by English law and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any claim or dispute arising under, or in connection with, these terms of use, except that, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law and we both agree to the exclusive jurisdiction of the courts of England and Wales.

Information we collect from you:

We will collect and process the following categories of data about you:

Information you give us. This is information about you that you give us by filling in forms on the website (www.lvs.ascot.sch.uk), interacting with the Site or by corresponding with us by phone, e-mail or otherwise. It includes information you provide when you register to use the site and when you report a problem with the Site. The information you give us will include your name, address, e-mail address and phone number, as well as preliminary information about your entry to the school (child(ren) name(s) and age(s), proposed term(s) of entry, boarding or day pupil(s), etc.).

Information we collect about you. This is information that we collect automatically about your visit during your time on the Site. It typically involves technical information and is often collected using small data files called “cookies”. This information helps us to provide you with a good experience when you browse the Site and also to indicate where the Site requires improvement. Information we receive from other sources. This is information that we receive about you if you use any of the other websites we operate. In this case we will have informed you when we collected that data if we intend to share those data internally. We will also have told you for what purpose we will share your data. This also includes information that we receive from third parties, such as business partners, sub-contractors in technical services, advertising networks, analytics providers, search information providers and so on. We will notify you when we receive information about you from them and the purposes for which we intend to use that information.

Uses made of the information:

All information about you that we collect or receive, whether of a personal or technical nature, may be used by us in the following ways:

  • To carry out our obligations arising from any contracts entered into between you and us and to provide you with the information, products and services that you request from us;
  • To provide you with information about other goods and services that we, or our selected partners, offer that are similar or relevant to those that you have already purchased or enquired about, such contact will only be made by email or SMS, from which you can opt out at any time;
  • To notify you about changes to our services;
  • To administer the Site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
  • To improve the Site to ensure that content is presented in the most effective manner for you and for your computer;
  • To allow you to participate in interactive features of our service, when you choose to do so;
  • As part of our efforts to keep the Site safe and secure;
  • To measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and

Information we receive from other sources. We will combine this information with information you give to us and information we collect about you. We will use this information and the combined information for the purposes set out above (depending on the types of information we receive).

Disclosure of your information:

We may share your information with:

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006;
  • Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you;
  • Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. Such information would not include anything that would make an individual identifiable to the advertisers, but we will provide them with aggregate information about our users (for example, that 500 users live within a particular area) to help them reach the kind of audience they want to target. We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to their selected target audience; and
  • Analytics and search engine providers that assist us in the improvement and optimisation of the Site;

 

We will disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets;
  • If we, or substantially all of our assets, are acquired by a third party, in which case personal data held by us about our pupils, parents and interested parents will be one of the transferred assets;
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or
  • To protect our rights, property or safety, or those of our parents, pupils or others.

No disclosure or transfer of your information will be to persons or entities outside of the European Economic Area (EEA).

Where we store your personal data

All information that you provide to us is stored on our, or our selected business partners’, secure servers within the EEA, for a period of 7 years, and we will take reasonable steps to protect your information in accordance with this policy, including (without limitation):

  • Installing a secure firewall;
  • Using anti-virus protection software;
  • Encrypting data; and
  • Carrying out regular back-ups.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of any data transmitted to the Site; and any such transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Your rights

You have the following rights under law in respect of your personal information:

  • The right to be informed about the collection and use of your personal information;
  • The right of access to your information to verify the legality of our use of it;
  • The right to request that inaccurate or incomplete information about you is rectified;
  • The right to request the deletion or removal of your information where there is no further reason for us to use it (such as you have withdrawn your consent or we no longer provide your children with education);

  • The right to obtain and reuse the information that we have about you for your own purposes;
  • The right to object to certain uses (such as for marketing purposes); and
  • The right not to be subject to a decision that has a legal effect on you that has been based on an automated decision.

LVS Ascot Alumni Privacy Notice

Your privacy is important to LVS Ascot. The information below sets out how we use and protect the information we may hold about you.

Data we hold

When you become a member of the LVS Ascot Alumni we will collect your name, email address, graduation year, school house, current employment or education status, current location and your marketing preferences should you wish to be contacted. This will be used to contact you regarding Alumni related matters.

How do we store your data?

Your data is stored digitally with Mailchimp, for which you can find their privacy policy here

How long do we keep your data for?

Your data will be kept until you request to leave the LVS Ascot Alumni, at which point it will be destroyed.

We do not share your data with any other organisation or 3rd party
